<p><span style="font-size: small;">On September 16, 2012 the Patent Trial and Appeal Board will begin considering petitions for inter partes review and post-grant review of covered business method (“CBM”) patents – proceedings established by the America Invents Act. Later, the PTAB also will consider petitions for post-grant review without limitation to any specific claimed subject matter. However, petitions for post-grant review of patents other than CBM patents are not expected for some time, as they only apply to patents that claim, or at one time claimed, priority to an application having a priority date on or after March 16, 2013. In other words, only patents issuing sometime after March 16, 2013 are eligible. Thus, the primary focus of the webinar will be on inter partes reviews and post-grant reviews of CBM patents but also will contrast these proceedings with those proposed for post-grant reviews generally.</span></p>
<p><span style="font-size: small;">The U.S. Patent and Trademark Office (“PTO”) has proposed regulations to implement post-grant patent practice before the PTAB and has published a “Practice Guide” to help understand and to supplement the proposed regulations. The webinar will explain how the proposed regulations are expected to implement the relevant statutes and what challenges they may present.</span></p>
<p><span style="font-size: small;">Finally, the webinar will identify some strategic considerations to contemplate before filing a petition for inter partes or post-grant review and during the proceeding, if one is instituted.</span></p>
<p><span style="font-size: small;"><a title="Nancy Link" href="http://www.rothwellfigg.com/attorney_Linck.php" target="_blank"><strong>Nancy J. Linck</strong>,</a> a member at <em>Rothwell, Figg, Ernst &amp; Manbeck PC</em>, specializes in intellectual property law, particularly in the biotechnology and pharmaceutical areas. She has a wide range of experience in private and corporate practice, including consulting and litigation at both trial and appellate levels and inter partes matters before the U.S. Patent and Trademark Office. In addition, she has served as an expert in numerous patent cases and as an arbitrator. <p><span style="font-size: small;">This seminar will take a real world examination of how courts determine whether a law firm is adverse to a current client in the fields of patent litigation, patent prosecution, and opinion work.  </span></p>
<p><span style="font-size: small;"><strong><a title="David Hricik" href="http://www.hricik.com/business.html" target="_blank">David Hricik</a></strong> practiced law for 14 years, first with Baker Botts then with litigation boutiques, principally litigating patent infringement, legal malpractice, and complex commercial litigation. During that time, he also taught as an Adjunct Professor of Law at the University of Texas School of Law and at the University of Houston Law Center.</span></p>
<p><span style="font-size: small;">He left full-time practice in 2002 and began to teach at Mercer. He principally teaches Law of Lawyering, Patent Law and LItigation, and Civil Lawsuits. He has authored or co-authored books on Property, Statutory Interpretation, Civil Procedure, and ethical issues in patent prosecution and litigation. He is nationally recognized as an expert in ethics in intellectual property law.</span></p>

<p><span style="font-size: small;"><strong><a href="http://www.fbrice.com.au/profile/Connie_Merlino.aspx" target="_blank">Connie Merlino </a></strong>is a Partner at <a href="http://www.fbrice.com.au/" target="_blank">FB Rice</a>, based in the Sydney office. Connie specializes in drafting patent specifications in a range of ICT technologies. Her experience covers areas such as software, telecommunications and data communications, security, databases and imaging. Connie is known for her ability to quickly comprehend high level mathematics and has extensive experience in application software, including business methods and internet applications. Particular examples include smart phone applications, formal verification of drivers for hardware devices, multi-spectral imaging, video processing and virtual networks.</span></p>
<p><span style="font-size: small;"><strong><a href="http://www.fbrice.com.au/profile/Manuel_Schmidt.aspx">Manuel Schmidt</a></strong>   is a member of the FB Rice Information, Communications &amp; Technology team. He graduated with a PhD in microelectronics engineering and his research topic was statistical timing analysis of digital, integrated circuits. He has a strong focus on mathematical theory, software engineering, and semiconductor technology. Manuel has published extensively in industry journals worldwide, and joined FB Rice in 2010 as a trainee attorney.</span></p>
